Sub: Stacking charges- Revision thereof.
Board vide letter No.TC-I/91/201/7 dt.
22.3.1995 had specified that charges being levied for detention of outward
consignments in railway premises beyond the permissible free time would be
termed as "stacking charges" which would be at the same rates as were being levied as wharfage charges and
the free time will continue to be reckoned as is being done in respect of
outward consignments.
2. Further Board, vide their letter No.TC-I/97/201/10 dt. 16.11.2000
have revised the rates of wharfage charges being leviable on inward
consignments not removed from the Railway premises after completion of
free time.
3. In view of revision of rates of wharfage charges, the need for
concurrent revision in rates of stacking charges has been under
consideration. The sanction of the Central Government is accorded to the
rates of stacking charges leviable after completion of free time for Group
I,II & III stations/ Goods sheds/ Railway sidings being revised from
31.8.2002( Thirty first August Two Thousand Two) as indicated in the
schedule at Annexure-I.
3.1 The term "First day" referred to in the Annexure-I is
defined as the day on which free time allowed for stacking the goods
completes. Subsequent days like 2nd day, 3rd day
etc., will be counted in reference to this day.
3.2 Rates of stacking charges given in the annexure-I will be uniformly
applicable to goods of all descriptions e.g. bulk, non bulk, loose or
bagged consignments.
4. This issues with the concurrence of the Finance Directorate in the
Ministry of Railways.

Transportation of confiscated
timber
from Lumding Railway Station.
Attention of the railway is drawn to Special Investigation Team (SIT)'s
letter No 8-15/NEC/2002/Pt.IX. dated 23.7.2002 addressed to all concerned, including your Railway on the above subject for compliance.
Regarding para (ii) of this letter, it is to clarify that the general
guidelines relating to indent of railway wagons, procedure for loading
minimum quantity of timber, registration of transporter etc. issued
under Board's letter of even number dated 31.5.2000 (Rates Instructions
No. 46/2000) need not be followed in this instant case as the entire
timber stands confiscated to SIT. However, the charging of freight will
be as per extant MWC (minimum weight condition) rules notified for the
commodity.
Regarding
para no.(vi) of SIT's letter
referred above, it is also to clarify that extant rules relating to
charging of demurrage/ wharfage would apply in this case.
Loading
of 39 wagons for transportation of confiscated timber is permitted from
Lumding Railway Station as one time exception during the quarter
June-August,2002 subject to the stipulation that unutilized wagons shall
not be available for transportation of any other timber as laid down in
para (i) of this letter.
In terms of the orders in
para(x) of the SIT letter commencement of the loading shall be permitted
only after the 'No Dues Certificate' is issued to the purchaser by SIT.

Ref: Board’s letter No. TCR/1017/2000/11 dated 12.8.2002.
In
view of the relaxation given in distance applicable for Mini Rake Scheme from
300 Kms to 500 Kms vide Board’s letter of even number dated 12.8.2002, the
matter has been examined afresh and it has been decided that the para 1 of the
Joint Procedure Order issued vide Board’s letter No. 2001/M(N)/951/45 dated
11/18-12-2001 may be modified as under:
“
BPC of the Mini Rake shall remain valid for 2 round trips (upto a lead of 500
Kms only) or 8 days, which ever is earlier provided:
(a) Rake integrity and circuit integrity is maintained.
(b) Rake is not kept stabled for more than 24 hrs.”
2. All other conditions
stipulated in Board’s letters under reference will remain unchanged.
3. As already advised,
these instructions will come into force with effect from 12.8.2002 and will
remain valid upto 30.9.2002.
4. The
earlier instruction dated 12.8.2002 and this instruction is issued in
consultation with the Traffic Transportation, Finance and Mechanical
Directorates in the Ministry of Railways.
5. All concerned may be
advised accordingly.

Tareweighment of empty wagons supplied to steel plants for loading
of
Iron and Steel consignments, Silica
Manganese and Ferro

Ref:
(i) Board’s letter of even number dated 27.7.2001.

Vide Board’s letters
quoted above, permission was given to Steel plants to weigh the tare of empty
wagons supplied to them for loading of Iron and Steel consignments up to
20.7.2002 and for loading of Silica Manganese/ Ferro Manganese consignments upto
26.8.2002. It has now been decided
to extend the validity of the permission for a further period beyond 20.7.2002
and 26.8.2002, which will be valid
upto 26.8.2003 unless revised earlier, subject to the fulfillment of following
terms and conditions:
i) No extra free time will be allowed for conducting such
weighment.
ii) The empty wagons should be weighed in presence of Railway staff and the
actual tareweighment of wagons found on weighment should be recorded and
countersigned by Railway Staff; and
iii) The actual tareweight recorded on weighment and the painted tareweight
should be specified in both the Railway Receipt and the Weighbridge Register.
2.
The payload of such tareweighed wagons shall be worked out by subtracting
the actual tareweight of wagons from the actual weight of loaded wagons.
If it is not possible to weigh the loaded wagons for any reason, the pay
load shall be worked out by:
(a) adding the difference between the actual tareweight and the marked
tareweight to the marked carrying capacity if the actual tareweight is less than
the marked tareweight and
(b) subtracting the difference between actual tareweight and the marked
tareweight from the marked carrying capacity, if the actual tareweight is more
than the marked tareweight.
3. Concerned
Zonal Railways should submit half yearly appreciation reports on the working of
the scheme indicating inter alia whether there is any difficulty in
implementation, the total number of wagons tareweighed giving wagon-wise details
of painted tare weight, actual tareweight, the difference, if any etc. The reports for the period August 2002 to January 2003 may be sent to
this office by March 2003.
4. In case continuance
of tareweighment is considered necessary beyond 26.8.2003, then the submission
of full data in support of the proposal need to be furnished well before the
expiry of extended period.
5.
This issues in consultation with Traffic Transportation, Mechanical and
Finance Directorate in the Ministry of Railways.

Issue necessary instruction to all concerned.

General classification of goods- Chapter VII Rule No.701(6)(i)-
minimum weight condition for charging of freight.

Board’s decision was communicated to Zonal Railways vide Board’s
letter under reference (copy enclosed for ready reference).
Some Zonal Railways have complained that the instruction issued by Board
in this regard is not clear enough and may lead to confusion.
In
view of the apprehension expressed by the zonal railways, it has been decided to
modify the second sentence of the Rule 701(6) (i) of IRCA Goods Tariff No.41,
Pt.I Vol.I on the basis of our instruction of even number dated 18.10.2001 as
under:-
“ However, in respect of commodities for which minimum
weight condition prescribed in this Tariff is 180 quintals and below per
4-wheeled B.G.wagon, the minimum weight for charge when loaded in BCX, BCN, BCNA
wagons should be twice that prescribed for a 4-wheeled wagon.”

Vide Board’s above referred instructions, sanction of Central
Government was communicated to Zonal Railway that for each 4-wheeled, 6-wheeled
and 8-wheeled wagons, a maximum of two, four and six Railway Receipts
respectively can be issued. It
was also stipulated therein that in all cases where more than one invoice/RR is
issued at the request of the consignor, an additional Rs.100/- be charged from
the consignor for each additional invoice/RR issued. These instructions were
valid upto 16.8.2002.

The matter has been further examined.
3.
Sanction of Central Government is hereby accorded to extend the validity
of above-referred instructions for a further period of one-year w.e.f.
17.8.2002.
2. Zonal Railways are requested to closely monitor the implementation of the
scheme and furnish details of the commodities for which the scheme has been
used. Year-wise and commodity-wise
details of loading and earning for various commodities for which the scheme has
been made use of by the rail users since 25.1.2000, when the facility of issuing
multiple RRs was initiated, should be furnished by 16.6.2003 positively to
enable the Board to further examine the matter.
3. This issues with the concurrence of the Finance Directorate in the
Ministry of Railways.
